Texas Property Disputes! Who Truly Owns the Fence?
Now that I am an adult I have googled things I never thought I would. I have looked up stuff like how old is too old to drive in Texas, and is warming up your car illegal?
I was doing yard work in my backyard and noticed some of my fences needed work. I live in a corner house so luckily the repairs weren't on a shared fence with any neighbor. Even though it wasn't that day, our shared fence will at some point need repairs or maintenance. Here is what I found about who is legally responsible for fence repair between two houses.
IS IT MY RESPONSIBILITY TO FIX THE FENCE?
Unfortunately, there is not a simple answer to this question. It all depends on where the fence lies on the property line. The responsibility is shared if the fence is sitting directly on the property line. In this case, you should write up an agreement with your neighbor and sign it to prevent any altercations in the future. There is no need if the fence sits completely on your or the neighbor's property the responsibility will be on whoever property is on.
HOW DO YOU FIND YOUR PROPERTY LINE?
Your neighbor and you might get into a heated discussion about this, so the best way to figure this out is to hire a surveyor. They will help you determine where your property line sits. Hopefully, you and your neighbor are as cool and don't have to get this far.
