Who Gets To Keep The Wedding Ring In A Texas Divorce?

So, things didn't work out and for some reason or another, you decide to get a divorce in Texas. There's a lot happening during a divorce. But, what if the question comes up about the wedding ring? If you bought the wedding ring, do you have the right to ask for it back if you do get a divorce and go your separate ways?

In a Texas divorce, the wedding ring is considered the recipient’s separate property, meaning the divorce proceedings are not likely to obligate him or her to return the ring – except in specific situations. The wedding ring and/or engagement ring is conditional only on the recipient’s acceptance of engagement – and not on the wedding itself. Many other states view things differently and consider the engagement and/or wedding ring as being conditional on the recipient’s promise of marriage, and the ring, therefore, does not become the property of the recipient until the marriage takes place.

A wedding ring is considered in the state of Texas a CONDITIONAL gift. A gift giver is not entitled to get the ring back in this case. But what if

• WHAT IF THE WEDDING IS CALLED OFF BY THE PERSON WHO PROPOSED AND BOUGHT THE RING?

If the wedding is called off in Texas? Do you have to return the ring then? Well, if the person who PROPOSED calls off the wedding....and that person also bought the ring...NO, the other person does NOT have to return the ring. It is considered a gift. This was proven in the case Curtis v. Anderson, 106 S.W.3d 251, 255 (Tex. Ct. App. – Austin 2003).

If somebody proposes to you and gives you a ring and then later YOU call off the wedding...YES, YOU NEED TO RETURN THE RING! It's all about intent. But if someone proposes to you and you decide NOPE not going to happen, in most cases you have to give the RING BACK!.
