
Wait? You Can Only Have 2 Garage Sales Per Year In Texas?
When was the last time you hit up a good garage sale? With all the ONLINE and Market Places on the internet, it's a wonder that the old fashion garage sales still exist. But, it does and I'm glad. Who doesn't like an old fashion garage sale? I still like to wake up on a Saturday morning and hit some up. And, while I like going to garage sales, I don't like having them. Did it once and yes, it's a lot more work than I thought. But, I know people who love to have Garage Sales all the time. So the question came up, how many garage sales can you legally have in the State of Texas? I didn't even know that there was a set amount that you can have.

Wait? Really? I thought you could have as many as you wanted. But, apparently, that's not the case. Wow, who knew?
According to the Office of the State Comptroller....
The Office of the State Comptroller regulates sales of this type. Residents are allowed to have only two such sales within a twelve-month period. Any more than two and the resident is recognized as a business and must obtain a sales tax permit from the state.
• HAVING MORE THAN 2 IS CONSIDERED A BUSINESS?
So the answer is 2. Had no clue. And, apparently, the reason is that more than 2 are considered a business.
- Residents seeking to operate a business from their homes must meet other city requirements, including obtaining a Certificate of Occupancy.
• DO YOU NEED A PERMIT FOR A GARAGE SALE?
I guess depending on which city or town you live in depends on whether you need a permit for a garage sale. There are certain cities that do, but there is a lot that don't. I've never heard of anyone ever getting a permit to have a garage sale.
So I guess to be on the safe side, if you're going to have a garage sale at your house, make sure you only do it twice a year at that location.
